On the long track of state aid development in Ukraine, the Antimonopoly Committee of Ukraine (AMCU) has finally taken an important step to put theory into practice. On November 20, 2018, the AMCU issued the first decisions qualifying two measures as incompatible state aid and ordering its recovery.
Given that the AMCU has so far been mostly engaged with state support granted by local authorities, it is little wonder that the first negative decisions concern state aid to public utility companies. Still, the decisions are definitely worth a closer look, as they provide some insights into the reasoning that the AMCU is likely to apply in similar situations.
